Affiliate Terms and Conditions

These Affiliate Terms and Conditions ("Affiliate Terms") govern your participation in the BrandSphere AI Affiliate Program ("Program"). By applying to or participating in our affiliate program, you agree to be bound by these terms in addition to our general Terms of Service and Privacy Policy.

1. Program Overview

The BrandSphere AI Affiliate Program allows approved partners to earn commissions by referring new users to our social media management platform. Affiliates receive a percentage of revenue generated from users they refer.

2. Eligibility and Application

To participate in our affiliate program, you must:

• Be at least 18 years old
• Have a valid email address and website or social media presence
• Comply with all applicable laws and regulations
• Not be a competitor of BrandSphere AI
• Submit a complete application through our affiliate portal
• Be approved by our team before earning commissions

3. Commission Structure

Our affiliate program uses a tiered commission structure based on performance:

• Bronze Tier: 15% commission (0-9 referrals, $0-999 earnings)
• Silver Tier: 20% commission (10-24 referrals, $1,000-2,499 earnings)
• Gold Tier: 25% commission (25-49 referrals, $2,500-4,999 earnings)
• Platinum Tier: 30% commission (50+ referrals, $5,000+ earnings)

Commissions are calculated on the first payment made by referred users and are paid monthly through Stripe Connect.

4. Payment Terms

Commission payments are subject to the following terms:

• Payments are made monthly on the 1st of each month
• Minimum payout threshold is $50 USD
• Payments are processed through Stripe Connect
• You must complete Stripe Connect onboarding to receive payments
• All payments are subject to applicable tax reporting requirements
• We reserve the right to withhold payments for compliance or fraud prevention

5. Marketing Guidelines

When promoting BrandSphere AI, you must:

• Always disclose your affiliate relationship clearly and conspicuously
• Use only approved marketing materials and messaging
• Comply with all applicable advertising laws and regulations
• Not make false or misleading claims about our services
• Not engage in spam or unsolicited communications
• Respect intellectual property rights in all promotional materials
• Not bid on our brand keywords in paid search advertising

6. Prohibited Activities

The following activities are strictly prohibited:

• Creating fake accounts or engaging in fraudulent activities
• Using misleading or deceptive marketing practices
• Violating any platform's terms of service or community guidelines
• Engaging in click fraud or artificial traffic generation
• Promoting our services in inappropriate or harmful contexts
• Using our trademarks or intellectual property without permission
• Engaging in any illegal or unethical marketing practices

7. Tracking and Attribution

We use cookies and tracking technologies to attribute referrals to affiliates. Referrals are tracked for 30 days from the initial click. If a user makes a purchase within this period, the commission will be attributed to the referring affiliate.

We reserve the right to adjust or correct attribution in cases of fraud, technical errors, or other exceptional circumstances.

8. Compliance and Monitoring

We monitor affiliate activities to ensure compliance with these terms and applicable laws. We may request documentation, review marketing materials, or audit affiliate activities at any time.

Affiliates must maintain accurate records of their marketing activities and provide documentation upon request.

9. Termination

Either party may terminate the affiliate relationship at any time with written notice. We may immediately terminate the relationship for violations of these terms or applicable laws.

Upon termination, you must immediately cease all promotional activities and remove any references to our affiliate program from your marketing materials.

10. Limitation of Liability

BrandSphere AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your participation in the affiliate program, including but not limited to loss of profits, data, or business opportunities.

11. Changes to Terms

We reserve the right to modify these Affiliate Terms at any time. We will notify affiliates of material changes by email and posting the updated terms on our website. Continued participation in the program after changes constitutes acceptance of the new terms.

12. Governing Law

These Affiliate Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BrandSphere AI operates, without regard to conflict of law principles.
